Terms and Conditions

By using the Services, you represent and warrant that:

• All registration information you submit will be true, accurate, current, and complete
• You will maintain the accuracy of such information and promptly update it as necessary
• You have the legal capacity and agree to comply with these Legal Terms
• You are not a minor in the jurisdiction in which you reside
• You will not access the Services through automated or non-human means
• You will not use the Services for any illegal or unauthorized purpose
• Your use of the Services will not violate any applicable law or regulation

You are solely responsible for complying with all applicable housing, anti-discrimination, equal treatment, privacy, and tenancy laws when using the Services. Room providers may use applicant information only to evaluate the relevant room application and may not use, disclose, copy, export, or retain applicant information for unrelated purposes.

Room providers must not create questions, scoring criteria, eliminating answers, messages, notes, or decisions that unlawfully discriminate against applicants or rely on protected characteristics where prohibited by law.

You may be required to register to use the Services. You agree to keep your login information confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

As a user of the Services, you agree not to:

• Systematically retrieve data from the Services to create a collection, database, or directory without written permission
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information
• Circumvent, disable, or interfere with security-related features of the Services
• Disparage, tarnish, or otherwise harm us and/or the Services
• Use information obtained from the Services to harass, abuse, or harm another person
• Make improper use of our support services or submit false reports of abuse or misconduct
• Use the Services inconsistently with any applicable laws or regulations
• Engage in unauthorized framing of or linking to the Services
• Upload or transmit viruses, Trojan horses, spam, or other material that interferes with the Services
• Engage in any automated use of the system, such as using scripts, bots, data mining, or scraping tools
• Delete the copyright or proprietary rights notice from any Content
• Attempt to impersonate another user or person
• Interfere with, disrupt, or create an undue burden on the Services or connected networks
• Attempt to bypass any measures designed to prevent or restrict access to the Services
• Copy or adapt the Services' software, including HTML, JavaScript, or other code
• Except as permitted by law, decipher, decompile, disassemble, or reverse engineer any part of the Services
• Use the Services to compete with us, copy our functionality, or operate a substantially similar service without permission
• Sell or otherwise transfer your profile
• Use the platform to discriminate unlawfully against applicants
• Submit false, misleading, or fraudulent information
• Harass, threaten, or abuse other users
• Collect or misuse applicant data outside the intended purpose of roommate selection
• Upload malicious software or attempt unauthorized access to the platform

The Services may provide you with the opportunity to create, submit, post, display, transmit, publish, or otherwise provide content and materials, including text, photos, listings, questions, answers, messages, notes, profile information, applicant information, and other materials ("User Content").

When you create or make available any User Content, you represent and warrant that:

• Your User Content does not infringe the proprietary rights of any third party, including copyright, patent, trademark, trade secret, or moral rights
• You are the creator and owner of, or have the necessary licenses and permissions to use and authorize use of, your User Content
• You have the consent of each identifiable person in your User Content
• Your User Content is not false, inaccurate, or misleading
• Your User Content is not unsolicited advertising, spam, or other forms of solicitation
• Your User Content is not obscene, violent, harassing, libelous, or otherwise objectionable
• Your User Content does not violate any applicable law, regulation, or rule
• Your User Content does not violate the privacy or publicity rights of any third party

Any use of the Services in violation of the foregoing may result in removal or restriction of User Content, suspension of your account, or termination of your rights to use the Services.

If you choose to register or log in using a third-party provider such as Google, we may receive basic profile information such as your name, email address, and profile photo, depending on that provider's settings. We use this information only for account registration, authentication, and profile setup. We do not access your contacts, friend lists, address book, or unrelated social media content.

The Services may contain links to other websites ("Third-Party Websites") as well as content belonging to or originating from third parties ("Third-Party Content"). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy by us, and we are not responsible for them.

Inclusion of, linking to, or permitting the use of any Third-Party Websites or Content does not imply approval or endorsement by us. If you decide to leave the Services and access Third-Party Websites, you do so at your own risk. You should review the applicable terms and policies of any website to which you navigate from the Services.

We reserve the right, but not the obligation, to:

• Monitor the Services for violations of these Legal Terms
• Take appropriate legal action against anyone who violates the law or these Legal Terms
• Refuse, restrict access to, limit the availability of, or disable User Content that violates these Legal Terms, applicable law, or user safety
• Remove from the Services files and content that are excessive in size or burdensome to our systems
• Otherwise manage the Services to protect our rights and property and facilitate proper functioning

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you acknowledge that our Privacy Policy applies to our handling of personal data and is incorporated into these Legal Terms. Our primary hosting is in the European Union. Some third-party providers may process personal data outside the EEA, including in the United States, using appropriate safeguards as described in our Privacy Policy.

These Legal Terms are governed by and interpreted following the laws of Croatia, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU and you are a consumer, you additionally possess the protection provided by the obligatory provisions of the law of your country of residence.

Arbor S j.d.o.o. and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Rijeka, which means that you may make a claim to defend your consumer protection rights in Croatia, or in the EU country in which you reside.

The European Commission provides an online dispute resolution platform, which you can access at ec.europa.eu/consumers/odr. We may be contacted at hello@my-roommate.app. We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration body, but we will consider doing so in good faith where required by applicable law.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

The Services are provided on an as-is and as-available basis. You agree that your use of the Services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranties or representations about:

• The accuracy or completeness of the Services' content
• Personal injury or property damage resulting from your access to and use of the Services
• Any unauthorized access to our secure servers or personal/financial information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or the like transmitted to or through the Services by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of any content posted, transmitted, or made available via the Services

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

Our liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to us. Certain laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:

• Your User Content
• Use of the Services
• Breach of these Legal Terms
• Any breach of your representations and warranties set forth in these Legal Terms
• Your violation of the rights of a third party, including intellectual property rights
• Any overt harmful act toward any other user of the Services

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

We will maintain certain data that you transmit to the Services for the purpose of providing, securing, supporting, and improving the Services. If you delete your account, we will anonymize or delete personal information associated with your account in accordance with our Privacy Policy and applicable law.

Some non-identifying records, transactional records, security logs, accounting records, or information already shared with other users may be retained where necessary for legal, security, dispute-resolution, accounting, or service-integrity purposes. Active listings may be deactivated and draft listings may be deleted.

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

You hereby agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices, policies, and records of transactions initiated or completed by us or via the Services.

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver of such right or provision.

We may assign any or all of our rights and obligations to others at any time. We shall not be responsible for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the remaining provisions.

There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or use of the Services.
